3E. Children’s Data (Strict 13+ Policy with Limited Exceptions)
CStudios only collects and processes personal data from users 13 years of age or older. Users under 13 are not permitted to create accounts or use services that collect personal information except as described below.
3E‑1. Parent/Guardian Authorization Exception — Verification and Record Handling
A parent or legal guardian may email administration@chillboiostudios.com with a government‑issued ID and a written legal statement explicitly authorizing the child’s use of a specified CStudios service, and confirming that such authorization is legally valid in their jurisdiction.
Parental ID verification and record handling:
- Verification: CStudios will perform reasonable administrative checks to verify the legitimacy of the submitted ID and the identity of the submitting parent/guardian. Verification may include manual review and cross‑checks.
- Email deletion: After verification, CStudios will permanently delete the original ID file from the email inbox and from the email trash folder so the ID image is not retained in email storage.
- No long‑term ID retention: CStudios will not retain the government‑issued ID itself in long‑term storage, backups, analytics, or public materials.
- Verification record: CStudios will store a verification record that excludes the ID image and any sensitive ID data. The record will include a screenshot of the parental authorization request with the ID redacted or removed, plus limited metadata (date/time of submission, child’s account identifier, verification outcome, and verifier identity or process).
- Retention and deletion: Verification records will be retained only as long as necessary to demonstrate compliance with applicable law, support account administration, or respond to disputes or audits, and will then be securely deleted per CStudios’ data‑retention policies; typically no longer than three (3) years unless required by law.
- Security and access: Verification records are confidential, protected with appropriate safeguards, and accessible only to authorized personnel.
- Deletion requests: Parents/guardians may request deletion of verification records to the extent permitted by law and consistent with CStudios’ need to retain records for legal compliance or dispute resolution.
- Scope and refusal: This procedure applies only where permitted by local law and only for the specific service for which authorization was requested. CStudios may refuse or limit authorizations that fail verification or are not legally valid in the parent/guardian’s jurisdiction.
3E‑2. Service‑Specific Terms Exception
A Service‑Specific Set of Terms may allow under‑13 users only for that specific service, not platform‑wide. Such terms must explicitly state age rules, data‑collection practices, and whether parental consent is required. Service‑specific terms may permit under‑13 access with or without parental consent depending on the nature of the service, the type of data collected, and applicable local law.
3E‑3. Compliance Statement
CStudios does not knowingly target, market to, or profile users under 13. Where under‑13 access is permitted under these exceptions, CStudios will document verifiable parental consent and follow applicable legal requirements.
4. Sharing and Disclosure

5G. Service Continuity, Shutdowns, and Outages
CStudios may temporarily suspend services, discontinue features, shut down specific services, or permanently close the platform at any time. CStudios is not responsible for any revenue, business interruption, lost profits, or other economic losses resulting from outages, maintenance, shutdowns, or permanent closures, to the fullest extent permitted by applicable law. No refunds, compensation, or restoration guarantees will be provided for such events except where required by applicable law.
6. Intellectual Property and Content
6A. Your Content
You retain ownership of content you upload. By submitting content, you grant CStudios a perpetual, worldwide, royalty‑free, non‑revocable license to host, display, reproduce, and use the content as necessary to operate the service. Do not upload infringing content.
6B. CStudios Content
All software, graphics, designs, names, and trademarks provided by CStudios are protected. Do not copy or create derivative works unless permitted.
6C. Backups and Caching
CStudios may retain cached or backup copies of content even after deletion.
6D. License for Advertising and Promotional Use — Carve‑Outs for Sensitive Content
Any content you upload, submit, or provide may be used by CStudios for advertising, marketing, promotional materials, showcases, demonstrations, and public communications. You grant CStudios a perpetual, worldwide, irrevocable, royalty‑free, sublicensable license to use, reproduce, display, modify, adapt, publish, distribute, and promote your content for any promotional purpose without compensation, credit, approval, or notification, except as follows:
- Sensitive content carve‑out: This license does not authorize use of content that contains sensitive personal data (e.g., medical information, financial account numbers, government ID images) or intimate images for promotional purposes unless explicit, verifiable consent is provided.
- Minors: Content that clearly depicts minors will not be used for promotional purposes unless verifiable parental consent has been obtained consistent with Section 3E.

7. Enforcement and Remedies
7A. Investigations
CStudios may investigate suspected violations and take action including warnings, content removal, feature restrictions, temporary suspension, permanent termination, or legal referrals.

Appeals may be offered at CStudios’ discretion and are not guaranteed.
7C. Disclaimers
Services are provided “as is” to the fullest extent permitted by law. CStudios does not guarantee uninterrupted or error‑free operation.
7D. Liability Limitation
To the maximum extent permitted by applicable law, CStudios’ liability for direct damages is limited to the amount you paid for the applicable service in the prior 12 months, or a nominal amount if none. To the fullest extent permitted by applicable law, CStudios is not liable for indirect, incidental, special, consequential, or punitive damages.
7E. Broad Discretion Over Accounts and Enforcement Actions
CStudios may take any enforcement action it deems appropriate, including warnings, restrictions, suspensions, permanent bans, content removal, feature limitations, or account deletion, with or without notice or explanation, to the fullest extent permitted by applicable law. Enforcement decisions are final except where CStudios voluntarily offers an appeal. CStudios is not liable for damages or losses resulting from enforcement actions. No refunds, compensation, or restoration will be provided for enforcement actions except where required by law.
7F. Appeals Handling Location

8. Changes to These Terms
8A. Modifications
CStudios may modify these Terms or Privacy practices. Material changes will be posted with an updated effective date.
8B. Alerts and Notifications (Not Guaranteed)
CStudios may, but does not guarantee to, post alerts in Discord, display login notifications, or present acceptance screens. Failure to see an alert does not exempt users from compliance.
8C. Acceptance of Changes
Continued use after changes constitutes acceptance.
8D. Service Discontinuation Notice
If CStudios elects to discontinue a service or the platform, we will post notice where practicable. Such discontinuation does not create liability for lost revenue, business interruption, or other economic losses beyond any refunds required by law.

10C. Waiver of Class Actions and Court Proceedings
You may bring claims only in your individual capacity. Class actions, class arbitrations, representative actions, and collective proceedings are not permitted.
10D. Arbitration Forum and Rules
Arbitration will be conducted by a recognized arbitration provider selected by CStudios under that provider’s rules. The arbitrator’s decision will be final and binding.
10E. Venue for Arbitration
Unless otherwise required by law, arbitration will take place in Lucas County, Ohio, or remotely via video conference.
10F. Severability and Fallback
If any portion of the arbitration or waiver provisions is found unenforceable, the remainder shall survive. If arbitration is unavailable for a particular claim, the parties agree to resolve disputes in the most closely available forum permitted by law.

CStudios does not currently have a registered DMCA agent and does not intend to appoint or register a DMCA agent for the foreseeable future. Until such time as CStudios elects to register a DMCA agent and publishes that agent’s contact information on legal.chillboistudios.com, copyright complaints should be submitted through the internal system when available. Because CStudios currently does not maintain a registered DMCA agent, certain statutory safe‑harbor procedures under U.S. law may not apply until registration occurs.
12C. Uploader Response Options
- Formal legal process — May require identity verification and a valid counter‑notice where applicable.
- Internal Moderation and Negotiation — CStudios may mediate disputes internally.
12D. CStudios’ Role
CStudios is not a party to legal disputes between users. Our role is to receive court‑issued case numbers and verify filings.
12E. Permanent Removal
Once a valid case number is submitted through the internal process or a court order is provided, the reported asset may be removed in accordance with applicable law and these Terms.
13. Law Enforcement Requests
13A. Requirement for Judge‑Signed Orders and Legal Compliance
CStudios will only disclose user information to law enforcement when required by law and, as a matter of policy, only upon presentation of a valid, judge‑signed court order, warrant, or subpoena, subject to applicable law and emergency statutory processes.
13B. Mandatory User Notification
CStudios will notify the affected user when their data is requested by law enforcement unless legally prohibited by a judge‑signed nondisclosure order.
13C. Submission Portal for Law Enforcement

13D. Scope of Compliance
CStudios will disclose only the minimum information required by the judge‑signed order. We do not provide voluntary backdoors or real‑time monitoring.

When legally allowed, users will receive a copy of the request, the requesting agency, the date, and the type of information requested. If a nondisclosure order expires or is lifted, CStudios will notify the user as soon as legally permitted.

14B. Entire Agreement
